Terms of Use (AGB) for KIsy
Status: January 2026
1. Scope
These Terms of Use apply to the use of the web app “KIsy” and all related services (the “Service”). They apply to consumers in the European Economic Area (EEA) and Switzerland to the extent we offer the Service there.
Any conflicting terms of the user do not apply unless we expressly agree to them.
2. Provider

3. The Service
3.1 Description
KIsy is an AI-based learning and coaching web app. Users can chat with digital “coaches” (AI avatars) to ask questions and receive learning-related content.
3.2 AI technology (OpenAI)
We use OpenAI services to provide AI functionality. Inputs (e.g., text or images) are processed to generate responses.
3.3 No professional advice / errors may occur
AI responses may be incomplete, outdated or incorrect. We do not guarantee accuracy, completeness or suitability. The Service is not a substitute for professional advice (e.g., medical, psychological, legal) and is not intended for emergencies.
The web app visibly indicates that all coaches are AI (not humans) and that errors may occur.
3.4 Minimum age and parental consent
You must be at least 13 years old to use KIsy. If you are a minor, you may only use KIsy with the consent of your parent(s)/guardian(s).
Important: We only enter into paid subscriptions with adults (typically parents/guardians).
4. Account
4.1 Registration
A user account is required. You must provide truthful information and keep it up to date. You must not register under a false identity.
4.2 Account and subscription
An account may be free depending on the offer. Certain features require a paid subscription. The applicable scope and pricing are shown before purchase.
4.3 Credentials
You must keep your login credentials secure and not share them with third parties. You are responsible for activities under your account to the extent you are at fault.
4.4 Free account / trial (if offered)
We may offer free access or trial features. Scope, duration and any limits/quotas are defined in the web app and may be adjusted by us.
4.5 Paid subscriptions
We offer paid subscriptions (e.g., monthly and annual). The concrete scope (e.g., available coaches/features/quotas) and the price are shown transparently before purchase.
4.6 Technical requirements
KIsy is a web app used via a browser. You need a current browser version and a stable internet connection. Additional information is provided in the web app (e.g., “Help”).
5. Use of the Service
5.1 Permitted purposes
You may use the Service only for private purposes and for educational/school learning. You must not share your account with third parties. Parents/guardians may allow their children to use the account under supervision.
5.2 Personal data of third parties
You must only use personal information of third parties as input if necessary for educational purposes and if you are entitled to do so. For example, you must not enter the name of a classmate.
5.3 Prohibited content and actions
You must not provide inputs that generate unlawful outputs or facilitate unlawful activities. In particular, you must not:
- generate outputs enabling or facilitating fraud;
- generate outputs containing or facilitating insulting, discriminatory or otherwise illegal content;
- attempt to bypass security measures or access systems/data without authorization.

5.5 Sharing outputs
You may share outputs only for learning purposes within your family or close private environment. If sharing in social media is justified in a specific case, you must comply with OpenAI’s sharing & publication policy: https://openai.com/policies/sharing-publication-policy/
5.6 Rights to inputs
You may only input content you are entitled to use. For example, you must not copy complete copyrighted works into the Service.
6. Provision, maintenance, availability, chat reset
6.1 Dependency on third-party services
Availability of AI functionality depends on OpenAI and other technical infrastructure.
6.2 Quality / state of the art
We continuously improve the Service (e.g., accuracy, timeliness, age-appropriate language) in line with the state of the art. We do not guarantee specific results; the Service is provided without a warranty of correctness.
6.3 Maintenance and planned changes
We perform maintenance and updates (e.g., security updates, performance improvements, coach/prompt updates). During maintenance, the Service may be partially or fully unavailable.
Notice: Planned maintenance is announced where possible at least 72 hours in advance via an in-app notice/pop-up. In urgent cases (e.g., security issues, acute incidents), notice may be shorter, where possible at least 24 hours.
Larger changes affecting key features are announced – where possible – with 2 to 4 weeks lead time.
6.4 Chat reset (deletion of chat histories) as a special case
To make coach/prompt updates effective and to ensure quality and security, it may be necessary to delete chat histories (per coach, per user, or in exceptional cases system-wide) (“Chat Reset”).
Chat Reset notice: We announce planned chat resets where possible at least 72 hours in advance via an in-app notice/pop-up. For urgent technical reasons, notice may be shorter (where possible at least 24 hours).
School holidays/public holidays: We aim to schedule maintenance and potential chat resets during periods with typically lower usage, especially during overlapping school holiday periods in Germany (in particular summer holidays) and nationwide public holidays. There is no entitlement to a specific timing.
6.5 Availability
We strive for high availability. Our target is 99% annual availability. Especially during the pilot phase, downtime of up to 10 days (cumulative) per calendar year may occur in exceptional cases (e.g., maintenance, updates, incidents, force majeure). No specific SLA is owed.
6.6 Usage budget / quotas (fair use)
To ensure fair use and to manage costs (e.g., AI compute costs), we may apply a usage budget/quota per billing period. The current usage budget is shown transparently in the web app (e.g., 0–100%).
- We may notify you when reaching a threshold (e.g., 80%).
- Once fully used, certain features (especially compute-intensive requests such as image analysis) may be restricted until the next billing period.
- The concrete setup may vary by plan and is described in the app.
7. Prices & payment
7.1 Prices
Prices vary by plan and term. The applicable price is shown before purchase.
7.2 Payment processing
Payments are processed via the selected payment method and its conditions. Stripe’s consumer terms also apply: https://stripe.com/de/legal/consumer
7.3 Prepayment
Payment is due in advance for the respective subscription term.
8. Term, cancellation, renewal
8.1 Deleting the account
A free account (if offered) can be ended at any time by deleting the account within the web app. Note: a paid subscription must be ended first.
8.2 Cancelling paid subscriptions
The term depends on the chosen plan. You can cancel a paid subscription effective at the end of the current term. Cancellation is available in the web app via subscription management (e.g., “Profile/Settings → Manage subscription”).
8.3 Renewal
If you do not cancel before the end of the term, renewal works as follows:
- Monthly plan: renews month by month.
- Annual plan: after the minimum term, renews for an indefinite period and can be cancelled at any time with a notice period of no more than one month where required by law.
8.4 Extraordinary termination by you
You may terminate for cause at any time stating the reasons. If the cause exists, termination becomes effective immediately. Payments for the remaining term will be refunded to the original payment method.
8.5 Extraordinary termination by us
We may terminate for cause if you materially violate these Terms (especially Section 5). Payments for any remaining term will be refunded, unless legal reasons prevent it.
8.6 Cancellation button
Where legally required, we provide an easily accessible cancellation function (“cancellation button”), accessible via the web app/website and/or subscription management.
9. Right of withdrawal
If you are a consumer, you generally have a right of withdrawal within 14 days. Details are provided in the German version of these Terms and the legally required withdrawal information shown during checkout.
10. Liability
Our liability is limited to intent and gross negligence and to the breach of essential contractual obligations (cardinal duties), and to injury to life, body or health, subject to mandatory statutory provisions.
11. Rights to inputs and outputs
We do not acquire rights to your inputs and outputs to the extent such rights exist. You retain your rights to your inputs. Any rights to outputs are governed by applicable law.
12. Consumer dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Changes to these Terms
We may update these Terms where necessary for legal, technical or operational reasons (e.g., feature changes, security requirements, legal changes). Material changes will be communicated with reasonable notice (e.g., via in-app notice). If you disagree, you can cancel your subscription and stop using the Service.
14. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws remain unaffected.
If any provision is invalid, the remaining provisions remain effective.
